Blue Jobs Terms and Conditions

1.ACCEPTANCE OF TERMS
By accessing, registering with, communicating through, or using Blue Jobs, whether through the website, WhatsApp, mobile device, social media, email, or any related service, you agree to be bound by these Terms and Conditions.
If you do not agree to these Terms, you may not use Blue Jobs.
2.NATURE OF THE SERVICE
Blue Jobs is a platform designed to connect workers and employers.
Blue Jobs is not:
- ◆An employer
- ◆A labour broker
- ◆A temporary employment service
- ◆A recruitment agency
- ◆A payroll provider
- ◆A staffing company
- ◆A guarantor of employment
- ◆A guarantor of workers
- ◆A guarantor of employers
Blue Jobs merely provides a platform through which employers and workers may connect.
3.NO GUARANTEE OF EMPLOYMENT
Blue Jobs does not guarantee:
- ◆Employment
- ◆Casual work
- ◆Temporary work
- ◆Permanent work
- ◆Interviews
- ◆Job offers
- ◆Income
- ◆Future opportunities
Registration on Blue Jobs does not guarantee that work will be offered or obtained.
4.WORKER INFORMATION AND AVAILABILITY
Blue Jobs does not verify, warrant, or guarantee a worker's skills, qualifications, experience, licences, certifications, identity, criminal history, honesty, or workmanship. Information about workers is supplied by the workers themselves, and it is the employer's responsibility to satisfy themselves as to a worker's suitability before engaging them.
Availability is different. Before an employer is charged, Blue Jobs contacts each worker about the specific job and only presents workers who have confirmed, in response to that job, that they are available and willing. This confirmation is made by the worker from their own WhatsApp number at the time of selection.
Blue Jobs confirms a worker's availability at the time of selection only. Blue Jobs does not guarantee that a worker remains available after their contact details are released to the employer. Once contact details are released, arranging and completing the work — including confirming continued availability — is a matter between the employer and the worker.
Where a worker's profile displays “SA ID Number Provided,” this indicates only that a number was supplied and passed a basic format and checksum check. It does not confirm that the number was issued by the Department of Home Affairs, that it belongs to the worker who supplied it, or that the worker is a South African citizen, permanent resident, or otherwise legally entitled to work in South Africa. Employers must not rely on this status as confirmation of identity, citizenship, immigration status, or work eligibility.
Employers are solely responsible for conducting any checks they consider necessary before engaging a worker.
5.NO GUARANTEE OF EMPLOYERS
Blue Jobs does not guarantee that employers:
- ◆Are legitimate
- ◆Will offer work
- ◆Will pay workers
- ◆Will pay on time
- ◆Will provide safe working conditions
- ◆Will comply with labour laws
Workers engage with employers entirely at their own risk.
6.PAYMENT RESPONSIBILITY
Blue Jobs is not responsible for:
- ◆Worker wages
- ◆Salaries
- ◆Daily rates
- ◆Casual labour payments
- ◆Overtime
- ◆UIF
- ◆PAYE
- ◆Tax deductions
- ◆Benefits
- ◆Medical aid
- ◆Pension contributions
- ◆Reimbursements
- ◆Expenses
All payment arrangements are solely between workers and employers.
Blue Jobs shall not be liable for non-payment, underpayment, delayed payment, disputed payment, or any payment-related loss.
7.EMPLOYMENT RELATIONSHIPS
Any employment relationship created through Blue Jobs exists solely between the worker and employer.
Blue Jobs is not a party to such agreements and assumes no responsibility arising from them.
8.USER INFORMATION
Users are responsible for ensuring all information provided is accurate, truthful, and current.
Users may not:
- ◆Provide false information
- ◆Misrepresent skills
- ◆Use another person's identity
- ◆Create duplicate accounts
- ◆Upload fraudulent qualifications
- ◆Mislead other users
Blue Jobs reserves the right to suspend or remove accounts without notice.
9.TRUST SCORES, RANKINGS AND MATCHING
Blue Jobs may use automated systems, algorithms, ratings, trust scores, response history, availability history, activity levels, profile completeness, employer feedback, worker feedback, location data, or other factors to determine visibility, rankings, recommendations, and matches.
Blue Jobs is not required to disclose how these systems operate.
Users acknowledge that rankings and visibility may change at any time.
Blue Jobs makes no guarantee that any user will appear in search results, recommendations, or employer matches.
10.RESPONSE TRACKING AND GHOSTING
Blue Jobs may track:
- ◆Response times
- ◆Availability confirmations
- ◆Missed responses
- ◆Declined opportunities
- ◆Cancelled engagements
- ◆No-shows
- ◆Employer complaints
- ◆Worker complaints
Failure to respond to messages or repeated failure to honour commitments may result in reduced visibility, lower trust scores, temporary suspension, or permanent removal from the platform.
11.REVIEWS, RATINGS AND FEEDBACK
Employers and workers may provide feedback regarding their experiences.
Blue Jobs may display ratings, trust indicators, badges, activity status, reliability indicators, or similar information.
Blue Jobs is not responsible for the accuracy of feedback provided by users.
12.SAFETY
Blue Jobs does not guarantee the safety of:
- ◆Workers
- ◆Employers
- ◆Work sites
- ◆Employment opportunities
Users are responsible for their own safety and should exercise appropriate caution when engaging with others.
13.LIMITATION OF LIABILITY
To the fullest extent permitted by law, Blue Jobs shall not be liable for:
- ◆Injury
- ◆Death
- ◆Theft
- ◆Fraud
- ◆Assault
- ◆Harassment
- ◆Property damage
- ◆Financial loss
- ◆Business interruption
- ◆Lost income
- ◆Lost profits
- ◆Data loss
- ◆Employment disputes
- ◆Labour disputes
- ◆Contract disputes
Users use the platform entirely at their own risk.
14.PLATFORM AVAILABILITY
Blue Jobs does not guarantee:
- ◆Continuous operation
- ◆Successful message delivery
- ◆Successful matching
- ◆Error-free service
- ◆Uninterrupted service
Blue Jobs may suspend, modify, restrict, or discontinue services at any time.
15.COMMUNICATION CONSENT
By registering, users consent to receiving communications from Blue Jobs through:
- ◆SMS
- ◆Telephone
- ◆Website notifications
These communications may include:
- ◆Job opportunities
- ◆Availability checks
- ◆Profile updates
- ◆Marketing communications
- ◆Platform announcements
- ◆Security notifications
Users may opt out of marketing communications where applicable.
16.PRIVACY AND POPIA
Blue Jobs will process personal information in accordance with applicable South African law, including the Protection of Personal Information Act (POPIA).
Users consent to the collection, storage, processing, and sharing of information reasonably required to operate the platform.
Blue Jobs may transfer personal information outside the borders of South Africa where reasonably necessary to operate the platform, including to service providers located in other countries. Blue Jobs will only do so where the recipient is subject to laws, binding corporate rules, or agreements providing a level of protection substantially similar to POPIA, or where the user has consented to the transfer.
Blue Jobs takes reasonable technical and organisational measures to protect personal information against loss, unauthorised access, interference, modification, or disclosure, in line with its obligations under POPIA.
Blue Jobs retains personal information for as long as reasonably necessary to fulfil the purposes described in these Terms or to comply with legal obligations, after which it will be deleted or de-identified.
In the event of a data breach reasonably believed to have compromised personal information, Blue Jobs will notify the Information Regulator and affected users as required by POPIA, as soon as reasonably possible after becoming aware of the breach.
Where the automated systems referred to in Section 9 are used to make decisions that materially affect a user, users may contact the Information Officer to request information about the basis of such a decision, in accordance with their rights under POPIA.

17.ADVERTISING AND PROMOTED LISTINGS
Blue Jobs may display:

- ◆Promoted employers

- ◆Featured listings
Blue Jobs makes no representation regarding advertised products, services, employers, or workers.
18.INTELLECTUAL PROPERTY
The following are the exclusive property of Blue Jobs:
- ◆The Blue Jobs name
- ◆Logos
- ◆Branding
- ◆Website content
- ◆Databases
- ◆Matching systems
- ◆Algorithms
- ◆Software
- ◆Designs
- ◆Text
- ◆Images
- ◆Documentation
- ◆Marketing materials
No user may copy, reproduce, distribute, modify, reverse engineer, scrape, extract, sell, licence, or exploit any part of Blue Jobs without prior written permission.
19.COPYRIGHT NOTICE

All content, software, databases, text, graphics, logos, designs, source code, images, documents, workflows, and platform functionality are protected by South African and international copyright laws.
Unauthorised copying, reproduction, distribution, publication, modification, or commercial use is strictly prohibited.
20.INDEMNITY
Users agree to indemnify and hold harmless Blue Jobs, its owners, directors, employees, contractors, agents, and affiliates against any claims, damages, losses, costs, legal fees, or liabilities arising from:
- ◆Use of the platform
- ◆Employment relationships
- ◆Payment disputes
- ◆User conduct
- ◆Breach of these Terms
21.TERMINATION
Blue Jobs may suspend or terminate any account at any time, with or without notice, for any reason deemed appropriate.
22.CHANGES TO THESE TERMS
Blue Jobs may amend these Terms at any time.
Continued use of the platform constitutes acceptance of any updated Terms.
23.GOVERNING LAW
These Terms shall be governed by the laws of the Republic of South Africa.
Any disputes shall be subject to the jurisdiction of the courts of South Africa.
24.REFUND POLICY
When you purchase a worker's contact details, you are paying for the release of a contact who has confirmed, from their own WhatsApp number and in response to your specific job, that they are available and willing at the time of selection. Because the worker confirms by replying from that number, the number is proven to be working. This contact is delivered in full the moment the details are released to you, and once released it cannot be returned. For this reason, all sales are final.
Refunds are issued only where Blue Jobs has failed to deliver as a result of a technical or system error on our platform, namely:
- ◆A duplicate charge for the same purchase
- ◆A payment processed in error due to a technical fault on the Blue Jobs platform
- ◆Contact details that were incorrect as a result of a Blue Jobs system error
Refunds are not issued in any other circumstances, including but not limited to:
- ◆The employer changing their mind after contact details were released
- ◆The employer and worker being unable to agree on a rate or terms
- ◆The employer being dissatisfied with the worker's skill, experience, or conduct after contact
- ◆The employer choosing not to proceed with the hire
- ◆A worker being unresponsive, uncontactable, or no longer available after they confirmed availability at the time of selection — including where this results from the worker's own circumstances (for example, no airtime, no signal, or having taken other work) or from delay by the employer in making contact
- ◆The worker's documentation or SA ID status not meeting requirements the employer had the opportunity to specify before payment
Refund requests must be submitted to support@bluejobs.co.za within 7 days of payment. Blue Jobs will assess each request against the categories above and reserves the right to decline requests that fall outside them.
